Photo Evidence to Be Required
in UIIA Tire Damage Cases
The process for documenting tire
damage, an important part of the interaction between equipment providers and
motor carriers that participate in the UIIA,
is about to change, for the better.
Starting on August 1, 2018, road
service providers will be required to use
photographic evidence to determine the
assignment of responsibility for tire damage under the UIIA in lieu of requiring the
motor carrier to return the physical tire
carcass. A new supplement to Exhibit C of
the UIIA will set forth specific tire marking
and photo guidelines that roadside service
vendors will use when documenting tire
damage. Vendors will submit copies of
the photos to both equipment providers
and motor carriers for billing purposes as
well as dispute resolution.
This new process will preclude equipment providers from mandating that

motor carriers must return the actual tire
carcass and address the safety concerns
associated with this practice. This action
implements recommendations that were
developed by the Photographic Evidence
Task Force under IANA's Maintenance &
Repair Committee.
"The biggest benefit is that the new
language in the UIIA precludes the requirement of returning the tire carcass," said
Debbie Sasko, assistant vice president of
IANA. "The change creates a much more
efficient method of assigning responsibility for tire damage through the use of
photographic evidence. The change also
should enhance safety."
"This change will certainly be a
positive for us especially from a safety
standpoint. How to properly secure the
casing has always been an issue. There's
an economic benefit as well not having
to make a trip to return that casing," said
Sharon Jespersen, director, per diem M&R
for Evans Network of Companies.
Educational Materials
Developed
At the request of the IIEC, the
Photographic Evidence Task Force
developed an information card that
outlines the Tire Marking and Photo
Requirements/Criteria as the Supplement
to Exhibit C of the UIIA. IANA has
distributed this educational flyer to major
roadside service providers, which were
asked to distribute the card among their
contractors. In addition, a Motor Carrier
Reference Tool listing the major roadside
vendors and the educational flyer are
available on the UIIA homepage.
While the method for providing
documentation of tire damage is
changing, the process for determining
responsibility remains the same under
the terms of the UIIA and its exhibits,
including each party's ability to utilize the
binding arbitration process as the final
step in dispute resolution.
