After a pause at the end of 2016
the utilization percentage of the
active truck fleet resumed edging
upward slowly in Q1, surpassing
98%. This tightness is being
reflected in the recent trends in
the spot trucking market with
rates running considerably higher
than normal. The utilization rate
is expected to continue to rise as
the implementation date for the
Federal Electronic Logging Device
mandate approaches in December
of this year. There is considerable
debate with regard to both the
extent of the regulation's impact
as well as its timing. Barring a
success for the Owner-Operators'
(OOIDA) last-ditch Supreme Court
appeal, the regulation will be
implemented on December 18. But
enforcement remains a big open
question. How much leeway will
the authorities grant to violators,
particularly in the early days of
the new regulation, how big will
the fines be and when will they
be levied? The answers to these
questions will have an impact on
the speed of adoption and the
consequent impacts on capacity.

conditions. Spot market prices have
been running well above historical
norms in recent months. If this
trend continues we can expect
to see spillover effects into the
contract and intermodal markets in
perhaps six months or so.

There was little change in the driver supply in the first
quarter of this year. Driver wages as reported by the
publicly-traded motor carriers actually took a small step
downward, reflecting seasonal slackening in demand.
At this point there are no fundamental changes on the
horizon that will affect the supply of truck drivers. Rather,
the action will be on the demand side with ELDs affecting
driver productivity and therefore more drivers being
required to perform the same amount of work. This should
result in increasing labor costs and overall tightness in the
market as the year progresses.

Crude oil prices are quite a bit higher than a year ago, but
the bulk of that upward movement occurred in 2016 Q2
and prices since then have been stable in the range of $50
per barrel. U.S. producers have continued to refine their
fracking techniques with the result that wells can now be
profitably drilled at current world crude oil prices. Fracked
wells can be drilled quickly, going from a standing start
to full production in a matter of weeks. This permits U.S.
drillers in locations such as the Bakken in North Dakota
and the Permian Basin in Texas to respond quickly with
additional supply when prices begin to rise. The net effect
is downward pressure that makes substantial increases
in price unlikely, barring a significant geo-political event
