The law governing federal campaigns changed on Sept. 14, 2007 with the signing of the Honest Leadership and Open Government Act of 2007 (HLOGA). The new law, which made significant changes to congressional ethics and lobbying rules, also revised the Federal Election Campaign Act of 1971, which regulates the conduct of federal campaigns. These changes impose substantial new burdens in two main areas: New Travel Restrictions The first important change to federal campaign law relates to campaign travel. Under longstanding Federal Election Commission regulations, federal candidates and campaign staff have been allowed to travel on either commercial or private aircraft, so long as the campaign pays certain specified rates for the travel. HLOGA changes this rule. House candidates and leadership PACs are now prohibited from using campaign funds to pay for travel on non-commercial flights. House candidates must now fly either on a commercial carrier or on a government-owned aircraft. They can no longer fly on a privately-owned aircraft, even if they pay for the flight. (There is an exception for flights on aircraft owned or leased by the candidate or by the candidate’s immediate family.)
