At the inquest held on December 29 and 30, Coroner Ernest DeBlanc read the autopsy report of City Physician Ferdinand Schumacher establishing the cause of death of Daniel C. Byerly as internal hemorrhaging from two of his wounds which had penetrated the spleen. Several witnesses, including officers Slabouski and Malone, were called to testify before Judge Eugene Staes of the Second Municipal Police Court in the case of State vs. H. C. Warmoth. After the cross-examination was completed on December 30, Judge Staes “remarked that he thought sufficient testimony had been brought forward.” Although Judge Staes was reluctant to dismiss so serious a case, he concluded that evidence and testimony clearly pointed to self-defense. As reported in the Daily Picayune on December 31, the Judge said to the defendant, “The evidence given in this case establishes that you were right in your action when you took the life of Mr. Byerly . . . I do not hesitate a single moment in declaring that you have acted in self-defense, although it is a very unhappy event . . . that such an occurrence should have taken place . . . . I will, therefore, dismiss you. You may go.” Following the Byerly incident, Warmoth continued to serve Louisiana and New Orleans as a state representative (18771879), member of the constitutional convention of 1879, collector of customs at New Orleans (1890-1893), and Washington lobbyist for the Louisiana Sugar Planters’ Organization during the 1890s. He ran for governor again as the Republican candidate during the 1888 election, but in the political climate of post-Reconstruction Louisiana lost to another former governor, the popular Francis R.T. Nicholls. The Macmillan Company of New York published Warmoth’s memoirs, War, Politics and Reconstruction: Stormy Days in Louisiana in 1930. Shortly thereafter, he died in New Orleans on September 30, 1931. — Pamela D.
