A Look at 6(d) Certificates for Unpaid Fees and Charges

A 6(d) certificate is a certificate
that a condominium association issues stating the amount
of unpaid condominium fees
and other charges due by a
unit owner. It is most commonly
requested at the time of a condominium closing or refinance.
It is important that any condominium fees or assessments or other charges that have been assessed
are stated on the 6(d) certificate.
The 6(d) certificate is binding upon
the association, so if a fee has been
assessed, even if it is not yet due,
it should be disclosed on the 6(d)
certificate. A 6(d) certificate should
be dated as of the date it is issued.
There are certain buyers and attorneys that will request that a 6(d)
certificate be postdated. The way
to avoid this issue is to ask them to
pick up the 6(d) certificate on the
date they need it so it is not postdated. The reason not to postdate
the certificate is that other charges
could arise including an emergency
assessment.
In the event you feel compelled
to modify the certificate to make
the buyer comfortable that all fees
have been paid through the end of
the month, you could just state that
the regular condominium fee for
the current month has been paid.
That is the item that most people
seemed to be concerned with.
