ecreational use of marijuana is now legal in Massachusetts and
Maine, thanks to initiative petitions approved by voters last November.
But lawmakers are still wrestling with the details of how to regulate retail
sales of the drug, which won't be allowed in either state until next year.

In Massachusetts, the governor recently
signed a compromise measure approved
by the House and Senate that will tax
marijuana sales at 20 percent. The compromise measure also resolved a dispute
over local control of retail marijuana
shops by creating a two-tiered approval
mechanism: In the 260 municipalities
where voters approved the marijuana
measure, voters would have to approve
any restrictions on local retail sales; in
communities where voters nixed the ballot measure, the town council or board
of aldermen could impose restrictions
without voter approval.
According to press reports, Norwell
and Pembroke have already passed
measures banning retail sales, while
Hanover, Kingston, Scituate, Halifax, and
Hanson have taken preliminary steps in
that direction. Additionally, Harwich,
Falmouth, Dennis, Sandwich, Yarmouth,
and Bourne have approved temporary
bans, pending a review of the impact of
retail sales on those communities. Town
officials in Brewster voted recently to put
the question to voters at the annual town
meeting in November.
In Maine, an 11-member legislative
committee working on the framework for
regulating retail sales has not yet decided
on where to set the tax rate and licensing
fees mandated under that state's marijuana law. The Maine law allows municipalities to establish licensing requirements
in addition to those enacted by the state,
and it allows them to regulate "the time,

place, manner, and number" of retail
marijuana establishments. Unlike the
Massachusetts law, which allows voters
in some communities to vote on retail restrictions, the Maine statute specifically
prohibits residents from voting on "any
regulations [governing marijuana sales]
adopted by a municipal legislative body."

'USE IT-IF YOU CAN GET IT'
Although residents of Maine and Massachusetts can now use recreational pot,
they won't be able to obtain it legally until
businesses are allowed to sell the drug,
beginning next year. (The trigger dates
for retail sales are February in Maine
and July in Massachusetts.) Because
marijuana isn't yet readily available (at
least, not legally), condominium associations haven't yet felt the full impact of

the new laws, but boards are beginning
to contemplate the likely impact on their
communities.
"It's still low on the radar screen," David Abel, executive director of property
management at FirstService Residential,
reports. "But [condominium associations] are definitely beginning to grapple
with it."
Condominium managers and attorneys confirm that they are fielding more
calls from board members, who want to
know: Do associations have the authority
to ban marijuana smoking in the community? If so, should they do so? And must
they allow owners to grow marijuana for
personal use, which both the Maine and
Massachusetts statutes allow? (Legalized
marijuana use will also create perplexing
questions for employers, which we cover
in the sidebar on page 45.)
Although the statutes are still new,
a legal consensus has formed around
what association boards can, should, and
should not do in response. Association
attorneys generally agree that associations have the authority to ban marijuana
smoking, just as they have the authority
to ban the smoking of tobacco, and they
advise boards to approach marijuana
restrictions in the same way-by obtaining the supermajority vote of owners
required to amend the association's
bylaws. (Boards can enact a rule barring
smoking in common areas, but it takes a
bylaw amendment to restrict smoking or
any other activity within owners' units.)
