TENANT, UNIT OWNER
AND ASSOCIATION VOTING
Tenants can't vote, right? Although it is
rarely done, an association can give the
right to cast the allocated votes to a particular unit to the tenant instead of the
unit owner. The Act provides direction
for this at § 34-36.1-3.10(c), which states:
If the declaration requires that votes
on specified matters affecting the condominium be cast by lessees rather than unit
owners of leased units: (1) the provisions
of subsections (a) and (b) apply to lessees
as if they were unit owners; (2) unit owners who have leased their units to other
persons may not cast votes on those specified matters; and (3) lessees are entitled
to notice of meetings, access to records,
and other rights respecting those matters
as if they were unit owners. Unit owners
must also be given notice, in the manner
provided in § 34-36.1-3.08, of all meetings
at which lessees may be entitled to vote.
It should also be noted that tenants
can, and often do, hold proxy from the
unit owner, so long as it is not prohibited
by the governing documents.
The Association can vote for the units
that it owns, right? No. Pursuant to §
34-36.1-3.10(d) of the Act, "No votes
allocated to a unit owned by the association may be cast."
It is important for boards and property managers to familiarize themselves
with the standards of the Act and to fully
understand and implement the requirements for casting proper votes found in
the governing documents for the specific
property at issue. If the vote being cast
is not being made by the right person, or
the instrument giving that right to vote
doesn't meet the proper requirements,
the vote could be disqualified. This could
result in the underlying action being
challenged, and possibly even invalided.
Seeing as how many associations don't
tend to meet their required percentages
or majorities by an overwhelming number of votes, it is important to make sure
that every vote will really count.
