Barresi, Esq.] In February 2015, a North Carolina condominium resident shot three other residents to death in a disagreement related to parking. Few condominium disputes are ever fatal, but parking problems often provoke both owners and residents. TYPES OF PARKING There are typically three different types of parking for condominium units. An exclusive use parking easement is one which is appurtenant to the unit. This means the parking space cannot be separated from the unit, and when the unit is sold, the exclusive use parking space must be part of the sale. An exclusive use parking space is a limited common area. Deeded parking spaces are rarer and may be sold separately from the unit via its own deed. The owner of the deeded parking space actually owns the land and air which comprise the space. Deeded parking spaces are found in urban high-value areas. Open unassigned parking is the third type of condominium parking. This means the entire parking lot is common area, and residents can park in any available space. AREAS OF CONCERN Plowing snow from the parking lot is a frequent area of concern.
