Condominium Resale Certificates Legislation Sweeping the Country to Cap Fees Real estate agent lobbies have introduced legislation across the country that arbitrarily invokes a cap on fees an association may charge for important documentation provided to purchasers during the sale of a condominium. Claiming that community associations and their managing agents are charging "exorbitant" fees for these important documents, legislation has been filed in Rhode Island and other states outside of New England. The important consumer protection information that resale certificates provide to purchasers includes community association financial obligations, insurance coverage, covenants and restrictions, financial stability, and more. In many cases requiring the engagement of the association's attorney, as well as insurance professionals, the information is custom for every unit and cannot be provided with just the "push of a button." The CAI Rhode Island Legislative Action Committee (RILAC) is advocating for community associations and is working with legislators to explain how this bill is not in the best interest of consumer protection and how it will negatively impact association homeowners.
