TM - August 2008 - (Page 19) In other countries, no standardized requirement exists for releasing information across regions, leaving pronounced gray areas for companies to try to find their way through. In Malaysia, the lack of a clear process for releasing criminal records often means government departments make internal decisions as to who may and may not have access to criminal records. The lack of consistency in this approach makes working through this process challenging to say the least. In other words, it is critical for companies to understand country-specific national and cultural differences when conducting verifications. Regional Screening Regulations Hong Kong and Singapore: Third-party criminal record checks are not available from police or courts, even with authorization. Certificates of No Criminal Conviction are issued to individuals for visa/emigration purposes only. Letters from foreign embassies must be provided. Thus, such certificates cannot be obtained for employment purposes. Taiwan: A citizen or resident can apply for a Police Criminal Record Certificate at any major police station. However, the police must inspect the applicant’s original national ID card. The applicant also has to provide a copy of a national ID card with the application form. The certificate is issued in three working days if no records, or possible records, are found. Macau: A citizen or resident can apply for Certificate of Criminal Record from the Macau government office. The police must inspect the applicant’s original ID card and take fingerprints.
