abandon the start-up.”7 Such stories are well known among attorneys and investors. Amit Aharoni, who was born in Israel, seemed to be on the path to achieving the American Dream. While a student at Stanford Business School, Amit founded an online booking company for cruises called CruiseWise.com. The company had nine U.S. employees and made a list of “20 Hot Silicon Valley Startups.” Yet U.S. Citizenship and Immigration Services (USCIS) denied Amit’s petition to work as the head of the company he founded. Amit described the letter he received from USCIS: “[The] letter is practically humiliating. It says you have to leave the country, as if I committed a crime of some sort by creating nine jobs,” said Amit.8 Amid levels of high unemployment in several U.S. states, including California, a federal agency’s decision to tell a business owner to pack up and leave got the media’s attention. ABC News featured Amit’s story prominently on a segment of World News with Diane Sawyer.9 The negative publicity

prompted U.S. Citizenship and Immigration Services to reconsider his application. A short time later, Amit received word that his petition had now been approved. While fortune shined on Amit Aharoni in the form a news story, no reporters were around a decade earlier to cover what happened to Alex Mehr and Shayan Zadeh when they started their company. Alex and Shayan met as students at Sharif University of Technology in Tehran, and they dreamed

of coming to the United States to study and start a business together. The first obstacle the two young men faced was getting a student visa to the United States. Without a U.S. embassy in Iran, Alex and Shayan needed to cross into Turkey on foot to find a U.S. consulate. Once at the University of Maryland, they shared a room and joined a competition for entrepreneurs. Along with two other friends, also international students, they developed a prototype for new business software and wrote a business plan. Although they didn’t win the contest (they earned the second place prize) the four young men formed a company. “Initially I wanted to become an academic but we were excited and saw a lot of potential [in our business],” said Alex. But none of them had considered U.S. immigration law. “Up until this point we had ignored the immigration aspects,” said Alex. The “immigration aspects” became apparent: an international student possesses no right to stay in the United States and work beyond a one-year period of practical train-
