Making the United States
More Attractive to Foreign
Skilled Workers
The U.S. Department of Homeland Security (DHS) recently announced two proposed regulations that would
help the United States attract and hold on to highly
skilled immigrants. The proposals focus on extending employment authorization to spouses of certain
H-1B visa holders, and enhancing employment opportunities for researchers and scholars by removing
obstacles to them remaining in the United States.
Here are the details:
Eligible individuals are H-4 dependent spouses of principal H-1B workers who:
n Are the beneficiaries of an approved Form I-140, Immigrant Petition for Alien
Worker; or
n Have been granted an extension of their authorized period of stay in the United
States under the American Competitiveness in the Twenty-first Century Act of
2000 (AC21) as amended by the 21st Century Department of Justice Appropriations Authorization Act. (AC21 permits H-1B workers seeking lawful permanent
residence to work and remain in the United States beyond the six-year limit.)

Enhancing Opportunities for Highly Skilled Workers
The proposal would:
n Update the regulations to include nonimmigrant high-skilled specialty occupation professionals from Chile and Singapore (H-1B1) and from Australia (E-3) in
the list of classes of aliens authorized for employment incident to status with a
specific employer;
n Clarify that H-1B1 and E-3 principal nonimmigrants are allowed to work for
their specific employer incident to status and do not need to separately apply to
DHS for an employment authorization card; and
n Add E-3, H-1B1, and CW-1 nonimmigrants to the list of nonimmigrants who
can continue to work for up to 240 days beyond their authorized period of stay
while their timely filed extension of stay application is pending..
"The proposals are a step in the right direction toward making the United States
more welcoming to global academic talent," said NAFSA Executive Director and CEO
Marlene Johnson. "We applaud the Obama Administration for making immigration
reform a priority and pushing these rules forward through the regulatory process."
"NAFSA has long advocated for regulations and laws that will make it easier
for talented people to come to the United States and be a permanent part of our
society. Our broken immigration system makes it difficult for people to attend our
colleges and universities, contribute to our economy, integrate into our communities, and educate the next generation of global leaders," she said.
The proposed rules were published on May 12, 2014, and provided a 60-day public
comment period. The rules will not become effective until DHS analyzes public comIE
ments and publishes a final rule with an effective date in the Federal Register.

Data on Stay Rates
for Foreign PhDs
Nearly two-thirds of foreign doctorates
stay in the United States 10 years after
graduation, according to a National
Science Foundation-funded report
from the Oak Ridge Institute for
Science Education.
The report, Stay Rates of Foreign
Doctorate Recipients from U.S.
Universities, 2011, shows that in 2011
the majority of doctoral graduates
staying in the United States hailed
from China and India. Other countries
with above-average stay rates
are Iran, Romania, Bulgaria, and
Yugoslavia. Low rates were found
among doctorate recipients from
Thailand, Jordan, Brazil, South Africa,
Chile, New Zealand, and Indonesia.
The highest stay rates were found
to occur in the field of computer
science, followed by computer and
electrical engineering. Agricultural
and social sciences and economics
are the fields with the lowest stay rates.
