After two months Fred puts in for an unpaid leave of absence (in accordance with your general three-month personal leave of absence policy) to give him time to try to adjust to new medication for the migraines. He anticipates starting the unpaid leave of absence in three weeks (about the same time his remaining available leave under the state FMLA runs out). His supervisor is now ballistic. He was planning on just letting Fred go when Fred failed to follow the attendance policy after Fred’s state FMLA leave was exhausted. The thought of now having Fred off on a three-month personal leave of absence is just galling to the supervisor. Analysis Fred has exhausted all leave but still has an issue needing leave. He first exhausted all available paid leave, and now he has exhausted all available protected leave. He is no longer out on a workers’ compensation qualifying injury. Life should be good, right? Nope, nice try. Fred applied for the leave of absence in accordance with policies so that he could try to address his migraines. You (and the supervisor) are on notice of Fred’s potential need for an accommodation under the Americans with Disabilities Act (and any state equivalent).
