HR Professional - June/July 2008 - (Page 15) UPFRONT TA L E N T | W O R K E R S A F E T Y | TA X C R E D I T S Health & Safety “Corporate killing” law gets first conviction Quebec’s Transpave Inc., a concrete block manufacturer is the first company convicted under the Canadian Criminal Code’s Bill C-45 or “corporate killing” law. The company, based in St. Eustache, Que., was convicted last December and was fined $110,000 in March. Introduced in 2004, Bill C-45 demands Canadian companies take all reasonable steps to prevent bodily harm to persons—including workers, contractors and the public. Accidents resulting in a failure to take these steps can result in criminal negligence charges along with regulatory health and safety contraventions. In October 2005, 23-year-old Steve L’Écuyer was crushed by a machine that stacks concrete blocks after pallets with concrete had backed up on the conveyer belt. Inspectors found the machine’s safety guard had been disabled for nearly two years. They concluded that management knew about the disabled safety guard and failed to inform L’Écuyer of the potential danger. That’s the third largest market segment behind men and women. Companies need people with disabilities,” says Lime Connect’s founder Rich Donovan, who was born with cerebral palsy. The students met with such global giants as PepsiCo, Frito Lay, IBM, Merrill Lynch, Citibank, Scotiabank and TD Bank at the oneday event. Companies at the event were impressed with the talent that came out. “In one hour, I met five or six potential employees, instead of sorting through a huge pile of resumés and finding maybe one, if I’m lucky,” said Scotiabank’s Erin Hunking. Lime’s long-term goals include “stepping up to the next level and focusing on the development of tools and processes that will help companies effectively source, hire, develop and market to people with disabilities,” according to Donovan.
