HR Professional - October/November 2008 - (Page 6) EDITOR’S LETTER COURTING DISASTER recently attended a seminar where I heard some very disturbing statistics: Canada ranks No. 4 on the list of countries with the most instances of workplace violence against women (it’s No. 5 for men). The No. 1 cause of workplace death for women? Murder. (It’s No. 2 for men.) Without a doubt, the fabric of the working landscape has changed dramatically over the last 20 years. No longer are workplace legal concerns confined to dismissal— they’ve expanded tenfold to include murder and a whole host of other issues including privacy, security, harassment, accommodation, overtime, retirement…the list goes on and on. You can’t be a senior HR professional today without working closely with legal counsel. And if it’s not a priority for your organization, it should be. Recent cases such as Keays vs. Honda Canada Inc. and the CIBC overtime lawsuit drive this point home. Richard Skinulis speaks to some of the country’s top employment lawyers, on page 30, to reveal how the critical employment law cases of the last 20 years affect your organization and what you need to do to keep your employer out of court. Tracey Starrett tackles the question of when to call in the legal cavalry, on page 37, and rounding out our legal theme, Hendrik Nieuwland navigates the tricky issue of changing employment contracts and constructive dismissal, on page 21. The October/November issue is jam-packed with other good reads, too—including a primer on developing workplace human rights policies on page 27, how to present to executives and look like the strategist you are on page 41, and, if numbers make your head spin, build your financial acumen, on page 42.
