DNR INTENT March 18, 2008, the Ofﬁce on Conservation notiﬁed all interested parties of the proposed amendments under Ofﬁce of Conservation Docket No. ENV 2008-01. A public hearing was held April 28, 2008 and afforded interested parties an opportunity to comment on the proposed rule amendment. The public comment period ended May 19, 2008. No comments were received concerning Docket No. ENV 2008-1. The Ofﬁce of Conservation has decided to adopt these proposed amendments to Chapter 5 of Part XIX of Title 43 of the Louisiana Administrative Code. Following is the Final Rule Amendment, which is being submitted to the Louisiana Ofﬁce of the State Register. On Katrina Relief Fund Update LOGA Katrina Industry Relief Fund has made its last ﬁnancial contribution to the community of Boothville in Plaquemines Parish. In October of 2006, Southern Mutual Help Association received a $639, 783 grant from the LOGA Katrina Relief Fund. Over the past two years, SMHA has been working to rebuild the homes, businesses and community of Boothville. In all, more than 21 businesses recovered or are in the process of recovery. This was made possible by $197,000 of grant money, $128,000 in loans and $37,000 worth of volunteer labor. Most importantly, 40 homes have been rebuilt or are in the process of being built. The reconstruction of the homes was covered by $439,000 in grant money and an incredible $672,000 in volunteer labor. The total direct investment in Boothville made possible by the LOGA Fund was $1,473,776.39. The Statewide Order No. 29-B – Commercial Exploration and Production of Waste Facilities (LAC 43:XIX.501,511,547,549, and 565) The Louisiana Ofﬁce of Conservation proposes to amend LAC 43:XIX.Chapter 5 (Statewide Order No.29-b) in accordance with the provisions of the Administrative Procedure Act, R.S. 49:50 et seq., and pursuant to power delegated under the laws of the state of Louisiana and particularly, Title 30 of the Louisiana Revised Statues of 1950, Sections 30;4 et seq. The proposed amendment modiﬁes the speciﬁc provisions at LAC 43:XIX.501.511/ A,547.G,549.C.3,540.D,549.E.2 and565.F which provide for deﬁnitions and ﬁnancial responsibility and establish the limitations for treatment, closure and on-site reusable material for the parameters of total barium and zinc at commercial Exploration and Production Waste (E&P Waste) land treatment facilities. The amendment to the above existing rules will revise and update operational limits for treatment and closure for total barium and zinc at commercial E&P Waste land treatment facilities. The amendment will also revise and update limits for total barium for on-site reusable material at commercial E&P Waste land treatment facilities. The proposed amendments is intended to update regulations to address changes in industry practices consistent with both state and federal environmental guidelines. Additionally, this proposal corrects and clariﬁes certain portions of Chapter 5 concerning deﬁnitions, commercial E&P Waste treatment and disposal options, and ﬁnancial responsibility requirements. 34 | LOGA INDUSTRY REPORT | FALL 2008
