The Connector - Fall 2008 - (Page 12) Fall 2008 RWAU Legislative Report Paul Fulgham, Rural Water Legislative Chair W ell, it’s that time again for a report of the legislative activity going on in the state and back in our nation’s Capital. In our world of water and water related issues within the state, we have the Executive Water Task Force and the Utah Water Coalition meeting and working on solutions to water issues in Utah. A few issues being worked on are: • Water rights being held for the future use of the public and the approach to utilize these rights incrementally based on current need combined with a segregation of the remaining water right applications being held for the future use of the public • Adjudication list changes • The removal of cumbersome adjudication requirements • The Water Ombudsman Legislative Option (this will probably not happen) • Action for review of informal adjudication proceedings • Water right conveyances • Administrative review of historic nonuse These are just a few items being discussed. Some of these will normally just fall off the work list, and we will maybe see them another time. The Sewer Lateral Marking Work Group has been working towards a compromise for SB 127 – Underground Utility Location Bill. Some of the compromise looks as though sewer utilities will have to show due diligence in the future for marking sewer laterals. It will most likely be required for utilities companies to mark the laterals installed afterwards if the bill is passed. As for my city utility, I have already instituted changes to the construction standards. This will help make an easy transition for my city crews who locate and mark the sewer utilities. On the national front, things aren’t too busy because of all the things that are up in the air with the up-coming election and all the “what ifs” that come with a new administration. We may see things start to move just before the election or maybe right after the election. And remember: We play an important role in the election, so let’s get out and vote.
