The EPA has announced a preliminary decision not to regulate perchlorate and has posted a notice seeking comments from the public regarding the decision. of two years experience OR a third party approved by the state. The system must correct any sanitary defects identiﬁed, if any. The state will consult with the system and, if necessary, provide assistance or require appropriate action. • Triggered by: 1. E. coli violation; 2. E. coli monitoring violation; 3. Two level 1 assessments within a 12-month period unless the identiﬁed problems were corrected; 4. Systems on annual monitoring with two Level 1 assessments in two consecutive years. • Being triggered into a Level 2 assessment does not constitute a violation, however, failure to complete the as- sessment within 30 days results in a treatment technique violation. Some other signiﬁcant changes for small (less than 1,000 people) community water systems: • Quarterly baseline monitoring for TC and E. coli. The state may reduce to annual monitoring. • To remain on annual monitoring, systems must have an annual site visit by the state or annual voluntary Level 2 assessment by a third party, clean TCR compliance history for 12 months and no defects in sanitary survey. • Increased monitoring to monthly following a level 2 assessment (or two level 1 assessments in a 12-month period); E. Coli MCL violation; treatment technique violation; or two monitoring violations (failure to collect samples). • To be eligible for baseline or annual monitoring following any trigger from the increased monitoring provision, systems must meet a set of requirements, and for annual monitoring, systems must adopt an extra measure that may or may not be on the list of additional enhancements.
