Feedback To the Editor: Edward Nagorsky’s article (“Lawful Enterprise,” June 2008) stating, “there is no compelling need for interior design legislation,” is extremely biased and supports only the limited educated persons who want to practice interior design, but do not want to study for four or more years and take an examination so they can call themselves “interior designer.” Licensure laws are enacted to protect the health, safety and welfare of the public, hence the need to license engineers, architects, contractors, electricians, plumbers, et al. Where does the interior designer fit into all of this build and remodel business? If Mr. Nagorsky were referring to those of the interior design profession who are truly “decorators,” then I would certainly agree with his premise. However, such is not the case when it comes to either non-residential interior design or those designers who remodel kitchens and baths. The protection of the public in building and remodel projects is the building code. For a project to become a legal part of said building, the owner, architect, contractor or designer must apply for a building permit and submit drawings to the department of building and safety in the municipality where the project is to be undertaken. Other than the owner, the person applying for said permit must have a license from the state. Hence the need for interior designers to be licensed if they are involved with the remodel of any portion of a structure that can affect the health and safety of the occupants. From my experience, I would say a person who designs kitchens and baths deals with electrical, plumbing, heat, ventilation and lighting. The basic minimum requirements are set forth in the building code. If drawings and specifications are not submitted for permit and the safety of the occupants is jeopardized, the designer may be held liable for all damages that are incurred. Most interior designer laws are to protect the term, “interior designer,” and are not practice acts. But in the law, requirements are set forth to ensure that the public that the people who call themselves “interior designer” are educated, have experience and have taken a test of that common body of knowledge. There are several professional organizations that represent the 9,000+ practicing interior designers. Each has its criteria for membership, which should not be confused with licensure, as that is the state’s option to determine what should be the requirements to practice in said state. It stands to reason that the state requests from the professional organizations what requirements would be acceptable to insure the health and safety of the public. However, the state should not favor one professional organization membership requirements over another and use that as a basis for their law. —Roger L.
