Notary Notes Magazine - DEMO - (Page 10) NOTARY NOTES Sister of Mercy Attorney Knows Notary Law Appreciates PAN When it Comes to Venue hen the Waldron Mercy Academy’s council asked Sister of Mercy Kathleen Ann McKee if she would serve as one of its notaries, she readily agreed. W “The council wanted to have more than one notary within our religious community so we would be available for the sisters who wanted to get documents notarized,” said Sister Kathleen, who has been a notary and a member of PAN since the early 1990s. “I receive calls from the sisters in the area, some of whom are taking over matters for their aging parents,” Sister Kathleen noted. “I help them with notarizing powers of attorney, living wills and advanced medical powers of attorney.” Sister Kathleen is now in her 30th year at the Academy, a coeducational Catholic school for Montessori and/or pre-kindergarten through eighth grade. She is the religious education assistant and assistant to the admissions director. The Academy is located in Merion Station, a suburb of Philadelphia. She loves the school and her work with the Sisters of Mercy and the students. Sister Kathleen also appreciates PAN’s service and support. “I have called in several times, and the customer service representatives are so pleasant. No matter what you ask them, they are very helpful,” she said. “And I love getting Notary Notes. I read it cover to cover. It always has something in it that I don’t know. T PAN would straighten everything out.” Gerhold picked the right ally to help fight his battle. “As an association our job is to serve our members,” Aronson said. “We knew Wayne was right and we knew this was just a misunderstanding that we could help clear up.” Aronson spoke with a representative at the Department of State who, in turn, turned the matter over to the Department’s chief legal counsel. After a call from the Department to the chief legal counsel at Pennvest, the matter was cleared up and everyone at Pennvest is now well aware of the notary law concerning where a notary can notarize a document. “For me, it was a matter of principle,” Gerhold said. “I knew the law and I was just adamant about getting this resolved. I couldn’t let it rest because I knew I was right.” Gerhold also knew where to take his fight. “PAN really backed me up,” he said. “PAN really helped me resolve this situation.” As an attorney and notary, Wayne Gerhold of Pittsburgh is clearly aware of the Notary Public Law. So, when a paralegal from Pennvest, Pennsylvania’s infrastructure investment authority, told Gerhold he could not notarize an affidavit for a client in Washington County because his rubber stamp seal showed Allegheny County as his office of record, he was more than a little upset. His anger grew after a Pennvest general counsel came to the same conclusion. “I was fuming,” Gerhold said, “because I knew as a commissioned notary I could notarize an affidavit anywhere in Pennsylvania.” Gerhold is a PAN member whose office just happens to be 14 floors above the PAN offices. A short trip down to the fourth floor was definitely in order. “I went to the PAN offices and (President) Marc Aronson told me that I was right and they were wrong,” Gerhold said. “He also told me that Now Offering Auto Insurance E.
