Deeds need to show the marital status of the parties, and may need to indicate that the property is not homestead. These requirements are not known to most people who are trying to save attorney fees by completing the deeds themselves. Many times failing to correctly fill out a deed results in title problems that end up costing more time, money and aggravation than can be imagined. The Clerk of Court, who in most counties handles the recording of deeds, will not tell you when there is a problem with the deed that is being recorded. However, the Department of Revenue does audit recorded documents to insure the proper recording taxes are paid. They are looking for transfers where only the minimum documentary stamps are paid. Indeed, individuals who are preparing deeds for themselves many times try to save money by representing that there was no money paid at the time of transfer. However, if there is a mortgage on the property, documentary stamps are due based on the amount of that mortgage.
