The U.S. Supreme Court has
repeatedly observed that, "[i]t is
difficult even for expert psychologists to
differentiate between the juvenile
offender whose crime reflects
unfortunate yet transient immaturity,
and the rare juvenile offender whose
crime reflects irreparable corruption.

Emphasize the categorical rule
of diminished juvenile culpability.

The bright-line rule of diminished juvenile culpability established by the U.S. Supreme Court
is a constitutional imperative, not a discretionary matter for the sentencing court. Under this
authority, juveniles are conclusively deemed to
possess certain characteristics, including: (1) a lack
of maturity and "an underdeveloped sense of

responsibility;" (2) vulnerability to peer pressure
and negative influences; and (3) characters that
are not fully formed or fixed.
These traits are associated with reduced
moral culpability and an enhanced capacity for
rehabilitation. They can provide a starting point
for an expert witness's opinion concerning an
offender's capacity for rehabilitation. They can
also explain questionable decision-making,
including affiliation with negative peer groups
such as gangs.

of expert testimony.

The U.S. Supreme Court has repeatedly observed
