concern to the DOC, would be helpful in moving
things forward. Establishing a friendly line of
communication with the Warden's Executive
Assistant or the health services administrator may
also help.
I prepared the petition, borrowing largely
from Attorney Goldberger's sample, as reprinted
in the Pa.ILP handbook. On August 18, 2017, I
finally filed the petition with all attached letters.
This was nearly a month after my initial phone
call with Frank's sister. I served everyone, as
required.11 In an effort to convince the assigned
assistant district attorney (ADA) not to object to
the petition, I provided all the medical records
in my possession, in addition to a copy of the
petition. On August 21, 2017, I learned that the
ADA assigned did not object to the release. In
Frank's case, there were no victims to be worried
about. This allayed much of my concern about an
evidentiary hearing.
On August 23, 2017, I received notice that
the Order was signed without the need for a
hearing. I breathed a sigh of relief, and then
faxed the Order to the state prison warden,
medical department, and records department.

The prison then requested a certified copy of
the Order. A certified copy was obtained and
faxed to everyone. Right before the end of the
business day, I received an email from the ADA
that DOC would not release Frank because they
insisted - despite a court order to the contrary -
on electronic monitoring. This is consistent with
DOC's legal interpretation of the compassionate
release statute (and with their mistaken idea that
they are a higher legal authority than a court),
but it is wrong. Release to a hospital or long-term
care nursing facility does require electronic
monitoring, as the statute states "under electronic monitoring."12 However, release to hospice
care does not require electronic monitoring, but
rather makes that added precaution discretionary
with the court, by using the different statutory
language "subject to electronic monitoring."13
The Order deferring Frank's sentence said "[t]his
release is not conditioned upon electronic monitoring." In my opinion, electronic monitoring was
not required by the statute; and more important,
the Order did not require it.
Despite my complete disagreement with
the DOC's position, I decided that acquiescence
