The Liberty Award

Commw. v. Wilmer: Amicus Filed: October 17, 2017

Joint Amicus)
Nature of the case: State troopers entered
Wilmer's residence, a sorority house, to help
a man who they observed on the roof who
looked in danger of falling. The troopers
caused some damage while entering the
house. By the time the troopers got to the
roof, the individual had fallen and was
being treated by first responders. With the
emergency over, the troopers were leaving
the residence when they observed a bag of
marijuana and a grinder. They seized the
contraband and left the residence. None of the
police activities to this point involved Wilmer.
The troopers, however, re-entered the house
without a warrant, purportedly to complete an
incident report. After re-entering the house,
one of the troopers walked to a bedroom and
knocked on a closed door. He was let in and
several women were present. When he asked
who lived there, only Wilmer indicated that
she did. Wilmer provided him information for
the report, during which the trooper observed
a marijuana pipe and a bong. Wilmer was
arrested. There was no evidence that after the
arrest the trooper continued to look for residents for the purpose of preparing an incident

The Alan Jay Josel Advocacy Award

Presented to a member in recognition of extraordinary
advocacy in one or more cases, causes or issues during
the previous year. The award recipient is selected by the
President after consultation with the association officers.
Nominations for the awards will close at 4:00 p.m.
on March 1, 2018 and will be circulated for review
and consideration. A nomination form can be
