Not every violation of a rule results in discipline.
Many Complaints are resolved with a dismissal of
the Complaint and a letter from ODC of education
or concern. These letters can have harsh wording,
but do not constitute discipline, do not have to
be reported to other jurisdictions and do not
count as a "first strike." The more serious forms of
available discipline are: disbarment; suspension by
the Supreme Court for a period not exceeding five
years; public censure by the Supreme Court with
or without probation; probation by the Supreme
Court under supervision provided by the Board;
public reprimand by the Board with or without
probation; private reprimand by the Board with or
without probation and private informal admonition
by Disciplinary Counsel.
After the response is filed, ODC may come back
and request additional information and additional
documents. Often, there is a significant waiting
period before ODC replies to the response. This
waiting period is nothing to be concerned about,
but simply reflects the fact that your matter may
be less urgent than other cases before ODC at the
time. ODC's principal job is to protect the public
and their priorities are cases where attorneys
present a danger to the consumer.
If the Complaint is not dismissed, the case
can go one of two ways. The parties can agree
to discipline, either private or public, or the case
can go to a hearing. If the case proceeds to a
hearing, ODC must file a Petition with numbered
allegations. When the Petition is answered, the
case becomes public and is viewable on the Court's
docket system. The first level of review is the
Hearing Committee which is comprised of three
volunteer attorneys, selected and trained by the
Disciplinary Board. The Hearing Committee takes
testimony and renders an opinion after post-hearing briefs are filed. The parties may file briefs "on
exception" if they disagree with the Committee's
opinion and request oral argument before the
Disciplinary Board. The Board reviews the facts
and the law de novo and issues a Report to the
Supreme Court, which conducts a third level of de
novo review.
What are the most common pitfalls for
criminal defense lawyers? By far the most common

causes of complaints against criminal defense
lawyers are lack of communication and neglect
of matters. To guard against this, set your clients'
expectations about your communication early.
Let them know that you will return their calls and
their family's calls as soon as possible, preferably
within 24 hours. Try to discourage them from
expecting instant responses and instant answers.
On the issue of neglect, for those in small and solo
practices, it is very difficult to manage a caseload.
The reality is that it is hard to turn down work.
However, as much as you can, be realistic about
what you can handle and be honest with the
courts and your clients; do not allow yourself to
become overwhelmed.
The other issues that come up frequently are
the related issues of engagement letters and fees.
All first-time clients must have written engagement
letters. Further, you are required to notify new
clients if you do not have professional liability
insurance of at least $100,000 per incident and
$300,000 total per year. If ODC is looking at you,
they will look at this disclosure issue. If you are
using a non-refundable fee that goes directly into
your operating account and not an IOLTA account,
you must disclose that in clear language in your
engagement letter. Your engagement letter should
define the scope of the engagement in precise
terms, especially if you are limiting representation
to pre-indictment or preliminary phases.
Mishandling client and third-party funds is one
of the most common causes of serious discipline.
There are relatively new rules about recordkeeping for IOLTA/trust accounts. These accounts must
be reconciled every month three ways: bank
statement to your general ledger and then to
each individual client ledger. These monthly reconciliations and all the supporting documentation
must be maintained for five years and producible
to ODC on demand. Failure to produce these
records can result in a Petition for a Temporary
Suspension. For solos and small firms, find a bookkeeper who understands IOLTA requirements; it is
worth the added overhead cost.
