tive during our meeting. He completed
a statement that included his understanding of his Miranda rights. He
agreed to continue the conversation
and told us what happened. He confirmed Mr. Smith’s story and explained
that because he did not have a deer tag,
he asked his friend, Dom Berk, to use
his unused harvest tag. Berk complied
with the request. I looked into this
and discovered the harvest tag was
reported as an archery harvest, which
was false. We were informed Berk was
out of town and would not be home
for several weeks. When he returned
home, WCO Czech interviewed Berk
and the same story was collaborated
and documented.
At this point I had three players —
Mr. Smith, who found the deer, Peter
Marks, who wanted the deer and Dom
Berk, who tagged the deer. I was still
uncertain if the deer was killed unlawfully or just found. My next logical step
was to visit the site where the deer was
found.
The next day I visited the site
along Crum Creek in an area that had
flooded a few times. The only remains
were some hair — there were no tissue
samples for testing. I found no signs of
foul play, nor bullet fragments during
my investigation.
At this stage, our remaining point
of interest was Berk. Our conversation
with Berk matched the stories shared
by his counterparts. We completed our
investigation and filed charges, which
included fraudulent statements on official documents, unlawful possession
of deer parts and failure to procure
required permits to possess wildlife. No
further information surfaced indicating
contradictions or foul play, so it seemed
Whale Tail was probably hit by a car.
This is an example of a situation that
could have been avoided and ended
without any charges. Familiarity with
current game laws and contacting the
Game Commission before taking the
antlers certainly would have made a
less interesting story, but it would have
made for a much happier ending for all
involved in this case.
As for Whale Tail, the antlers were
officially scored at a net 160 6/8 typical
(which exceeds the Boone & Crockett
Club’s Awards Program minimum score
of 160-0/8). Michael Malley (see previous story) is confident Whale Tail was
6½ years old. It was an unhappy ending
for a magnificent deer.
It’s the Law:
Q: I came upon a road-killed trophy buck and wanted to keep
the meat and antlers. What do I have to do?
A: A Pennsylvania resident can pick up the animal and call it in to the PGC
within 24 hours to obtain a “consumption permit” for the meat and instructions
on what to do with the head and hide. The only way to retain the antlers is to
purchase them from the Game Commission at $10 per point, if the Commission
decides it will sell them rather than retain them.
