PROView - July 2008 - (Page 3) Chairman-Elect of the Board for the following year and they must complete the Grievance and Professional Standards training provided every year for Grievance and Professional Standards committee members. By being part of the Grievance Committee you not only help ensure that your peers follow the Code of Ethics, but you will become more aware of how the Code of Ethics influences your industry. Professional Standards Committee Members who have served a cumulative number of three years on the Grievance Committee may qualify to serve on the Professional Standards Committee. When a complaint or arbitration is referred to Professional Standards for a hearing, a panel of three members is selected to hear the case. This is the group that after determining the facts in a ethical case makes a decision as to whether there is a violation of the Code of Ethics. In the case of arbitration, the panel weighs the factors of procuring cause and determines which party should be awarded the commission or fee. It is important to know the Professional Standards hearing panels do not pursue legal issues and they have no jurisdiction over licensing issues as those are handled by FREC. The Professional Standards enforcement process deals exclusively with the Code of Ethics and its application to REALTORS®, their customers, and the general public.
