Kat McCoy, MLS Manager Response to a Recent Letter I received an email from an agent who had come across a property that was never listed as active yet closed just a few months ago. The agent was upset because of what was perceived as a clear violation. Please read my response, highlighting how some properties list because of their statistical value rather than that of actively being listed for sale. Dear Agent, There are instances when properties are sold outside the MLS: • You may have a seller who specifically requests in writing that their listing not appear in the MLS, or the listing does not meet the requirements of the MLS (Section 4.2 – Listing Contracts). • You may be working with a buyer and find a property not listed in MLS. It could not listed because the listing agent is out of the area, a FSBO listing, or maybe a listing that does not meet the requirements of the MLS such as a net or open listing. The MLS rules allow agents to enter these listings for statistical purposes. In the example you provided, the reporting agent, also the selling agent, entered the listing specified as statistical entry after it was sold. So why are statistical entry-listings allowed? They are essentially helpful in order to perform comparative market analyses and can not be entered until after the property has closed escrow. Usually a statistical entry listing includes either a listing agent or a selling agent that is not affiliated with the MLS. However, the cooperating broker (and agent) would like credit for their portion of the sale. Here are a few helpful tips for entering statistical entry listings: Enter the property as any other except for the following steps: 1. • When the system asks for list type (normally where you choose exclusive right or exclusive brokerage), select statistical entry. If you were the listing agent but did not put the listing in the MLS because the owner made such a request, enter yourself as the listing agent as you normally would and make sure you keep the written request of the owner on file. Go ahead and report the sold information, including the selling agent office and agent number. Note: If the Selling Agent was either not a REALTOR® or not a REALTOR® in the Tampa Bay area (for example an Orlando REALTOR®) please select non-MLS member as the selling agent (MLS ID: 999999, Office ID: 599999) If you were the selling agent, TEMPO needs to have the listing office and listing agent show as “non-MLS”. You will need to contact the MLS Help Desk (344-7767) and have them make the change for you. After all of the listing entry is complete, including all required fields, save it as an active listing. Immediately go back to add/edit to add your pri mary photo. Choose change status to move this listing to sold. October 2007 15 • 2. 3.
