The following year Universal Studios and the Walt Disney Company sued Sony on the basis that the company was manufacturing a product, the VCR, that would allow for video copying and thus copyright infringement, and that Sony was liable for such infringement. The case went to district court and appeals court, the latter of which held Sony accountable. Finally the Supreme Court ruled in January 1984 in favor of Sony. The decision let retailers buy video tapes and rent them to consumers while studios made money off of those initial sales to retailers, thus helping to create the home entertainment industry. “The Sony Betamax ruling is the most important copyright decision for the home entertainment industry,” said Fred von Lohmann, of the Electronic – Billy Gil Frontier Foundation. Warner Bros. and 20th Century Fox have reached a pre-trial settlement regarding rights to Warner’s superhero movie Watchmen, due in theaters March 6. Under the confidential agreement, Fox reportedly will receive 8.5% of the film’s gross, plus a percentage of revenue from sequels and spin-offs (including presumably Blu-ray and DVD), undisclosed cash, and payment of legal fees and development costs. LEGAL “Warner Bros. acknowledges that Fox acted in good faith in bringing its claims, which were asserted prior to the start of principal photography,” the studios said in a joint statement. “Fox acknowledges that Warner Bros. acted in good faith in defending against those claims.” The fate of the film had been up in the air after U.S. District Court Judge Gary Feess Dec. 24 ruled Warner violated select theatrical rights held by Fox to copyrighted material.
