Governor Lingle, said, “We respect everyone’s right to voice their opinion, but we will not allow a small group of protesters to act out in a lawless manner to obstruct the operations of a legitimate business, intimidate the people who wish to use its services or put people’s lives at risk.” The governor also cautioned that anyone who was planning to recruit children or teenagers to participate in illegal protests could be held liable for child endangerment. During the demonstrations that met the Superferry upon its first two voyages to Kauai several children were on surfboards in the harbor and came dangerously close to the Alakai and Coast Guard vessels. The Coast Guard said that protesters who failed to comply with orders pertaining to the security zones, purposely injure or threaten to injure an enforcement officer or attempt to destroy or interfere with vessels, could be punished by imprisonment for up to 10 years, and may be fined up to $25,000. Any vessel used to violate a security zone, including surfboards, kayaks and canoes, may be immediately confiscated and forfeited. WHALE STRIKES, INVASIVE SPECIES Environmental groups fear that the ferry could increase the risk of whale strikes and spread of invasive species. Barry Fukunaka, Director of Hawaii’s Department of Transportation, said the state supreme court’s decision to require an environmental assessment for harbor improvements made for the Hawaii Superferry “a dramatic change to the legal landscape and long-held state policy.” Fukunaka said the state’s acquisition of barges, installation of boarding ramps and minimal improvements to piers to accommodate the Hawaii Superferry fell “within the intended use of our harbors and consisted of minimal improvements therefore, in our opinion, qualified for an exemption.” He cited several other cases where harbor improvements were made and exemptions were granted.
