Beyond the spillage of 58,000 gallons of bunker fuel and its environmental damage to San Francisco Bay and water fowl, the accident—not surprisingly—unleased an outflow of political knee-jerking and litigation, including two class-action lawsuits filed by fishermen and a court order for the “arrest” of the ship. Furthermore, the U.S. National Transportation Safety Board (NTSB) has opened an investigation into the incident. The accident occurred on Nov. 7 when the 900 ft containership Cosco Busan with a San Francisco pilot onboard allided with a tower of the San Francisco-Oakland Bay Bridge in heavy fog. The accident ripped a 200 ft long tear in the port side of the ship (see U.S. Coast Guard photo), opening several fuel tanks. One of the lessons learned already from the accident is that there is a need to better coordinate efforts with local authorities. In testimony before House Trans- portation and Infrastructure Committee Subcommittee on Coast Guard and Maritime Transportation, San Francisco Mayor Gavin Newsome called for changes to existing federal regulations and protocols for oil spills that were implemented after the Exxon Valdez accident. These protocols left local expertise sidelined, said Newsome. Newsome said, “Although the city continued to register our concerns about the need for local involvement, it was not until (Nov. 10) that Unified Command began to actively incorporate city officials into the disaster response.” In a statement on Nov. 16, ADM Thad W. Allen, Commandant, U.S. Coast Guard admitted that the Unified Command had some “miscommunication” in the first day of the allision. Allen has directed the Coast Guard Chief of Staff to initiate an Incident Specific Preparedness Review to examine the implementation and effectiveness of the Area Contigency Plan and its integration with other applicable contigency plans at the federal, state and local levels. The review will also evaluate the effectivenes of the Coast Guard’s oil spill response and communications efforts. An initial report will be released within 90 days with the hopes of not only providing a clearer picture of what happened that day, but also leading to improved preparedness and response in the future.
