The View From Washington Political Vulnerabilities of Foreign-Based Companies in the New Congress T he recent swearing in of Al Franken as the junior Senator from Minnesota, which completes the 2008 federal election and, on paper, gives Democrats a de facto super-majority* of 60 votes in the U.S. Senate, provides an ideal time to gauge the attitudes toward and political vulnerabilities of foreignbased companies in the new Congress. The Current Landscape Before getting into the good news, and the bad news, surrounding the attitudes toward foreign subsidiaries in the new Congress, it may be insightful to consider the current landscape in Washington. Here, it is no stretch to say that the economic crisis has had far-reaching effects on public perception and government policy and that trust in corporations as a whole has been eroded.The Washington office has seen signs of reflexive protectionism in the form of “Buy America” provisions, as Americans worry about jobs and national competitiveness. In this environment Congress has come under pressure to close revenue gaps and is looking for politically salable targets for new and increased taxes. It is also no secret that foreign companies make a potentially easy target for rhetoric and taxation. In fact, the current landscape in Washington has turned so far that new Washington Post figures point to an increased trend of those who disapprove of the way President Obama is handling his job as president (see chart below). * The United States Senate requires a supermajority of three-fifths to invoke cloture, which closes debate on a bill or nomination, thus ending a filibuster by a minority of members. In current practice, the mere threat of a filibuster prevents passing almost any measure that has less than three-fifths agreement in the Senate.
