He described a “perfect storm” of enforcement, regulation and State Attorney General lawsuits, that he says make active management of regulatory compliance a necessity today. “Much of the problem in the industry is that over the years, we have been reactive to laws, regulations and rules,” said Maldonado. He urged providers to give up their “willful blindness,” and begin actively managing what is on cards to assure compliance. Active management involves an ongoing self-education process to make sure operators know what is required by the various agencies at the state and federal level. A frequently asked question was whether FCC certification was sufficient to sell cards, or if individual state certifications were also necessary. “There are 11 states where prepaid cards are named specifically,” advised Maldonado. “In general, there are laws on the books that say that you cannot provide telecommunications services Does your PREPAID BUSINESS feel like a CRAPS SHOOT? Maldonado said that California has been particularly active recently in enforcing their laws. “There have been laws on the books for many years that have not been enforced,” added Maldonado. “As a part of the attorneys general investigations, it is starting to bubble up the fact that maybe the public utilities commissions were not being as stringent as they should have been.” The second part of the process is documentation; making sure that procedures are in writing in case of an investigation. “What they are looking for is that you have better practices and procedures documented,” said Maldonado. “At the end of the day, if something does happen, they need to come back and take a look at you. That is going to require some kind of audit, or review.” Maldonado suggested that electronic record keeping can allow even small companies to maintain proper records while still focusing on business operations and sales.
