Vacation Terms and Conditions Thank you for choosing AIR JAMAICA VACATIONS®. To ensure that you understand the terms and conditions of your particular vacation, please read theRoute following completely. All terms and conditions are subject to change at anytime at AIR JAMAICA VACATIONS® sole discretion. Booking/Payment Policies AIR JAMAICA VACATIONS® accepts the following forms of payment: (1) certified check, money order or agency check (2) credit cards: American Express, MasterCard, Visa or Discover Mail payments to: Air Jamaica Vacations, Attn: Revenue Accounting, P.O. Box 1460, Milwaukee, WI 53201-1460. Once you have made the decision to travel with AIR JAMAICA VACATIONS®, a deposit of $150 per person will be due within 7 days after booking. An additional deposit may be required for holiday travel, peak periods and promotional sales. Upon receipt of deposit, your booking becomes a confirmed reservation. Full payment for confirmed reservations is due 45 days prior to departure. Bookings made less than 45 days before departure require immediate payment in full. All payments must be received when due to avoid automatic cancellation. Documentation Documents including airline tickets (except for bookings including infants under the age of two) and land arrangements will be sent electronically to the email address provided at time of reservation. AIR JAMAICA VACATIONS® is not responsible for non deliverable emails. Always check your electronic documentation for accuracy upon receipt. Late Bookings Bookings made 14 days or less before departure will incur a $25 fee to cover additional expenses to process the reservation. Cancellations/Refunds To minimize penalties, please advise us immediately should you wish to cancel a confirmed reservation. These charges below are in addition to individual hotel, feature and airline penalties. DEPARTURE CANCELLATION PENALTY PER PERSON 46 or more days prior to departure $25; 45 – 22 days $100; 21 – 0 days $150 Additional Charges: Depending on the airfare, from $100 to the full amount of the airfare may be forfeited. Hotel penalties often apply, and the amount varies by hotel. Penalties up to the full amount paid may apply over holidays, peak periods and promotional sales. Travel Protection is highly recommended. No refunds can be made for unused services or inclusions. All paper tickets and vouchers must be returned before a refund can be issued. Please allow 4-6 weeks for processing refunds after notification and AIR JAMAICA VACATIONS® receives your tickets and vouchers. IMPORTANT TRAVEL INFORMATION Travel Insurance Travel Protection Plan for 2008- see page 76 for details. Passport Requirements U.S. citizens must present a valid passport. Foreign travelers please visit your local consulate for travel requirements (VISA or other written verification). The Map airline cannot board any passenger who fails to carry proper documents. AIR JAMAICA VACATIONS® will not make any refunds due to your failure to bring the proper documentation. A driver's license is not acceptable as proof of citizenship. Miscellaneous Air Jamaica allows each passenger to travel with two checked bags (maximum weight 50 lbs each) plus one carry-on bag (maximum weight 30 lbs). Additional baggage may incur excess baggage charges. Excess bags will not be accepted on flights to Jamaica December 19 - 25 and Grenada & Barbados December 1 - 31. All claims for loss and damage to luggage must be handled by the air carrier at the airport. You must check in at least 2-1/2 hours prior to the scheduled departure and report to the gate at least 30 minutes before departure time. Failure to comply with these conditions may result in the loss of your seat. Porterage at airports, tips to sightseeing guides, tips in restaurants, to hotel bellmen and chambermaids; items of a personal nature such as laundry, phone calls or any other items not specified as included are not included in the package price. AIR JAMAICA VACATIONS® reserves the right to reinvoice your reservation at any time should an error be made in computing your vacation price. RESPONSIBILITY Airline Responsibility The conditions of carriage in use by the airlines concerned shall constitute the sole contract between the airlines and the purchaser of these tours and/or vacations. The airlines concerned are not liable for any act, omission or event occurring while the passengers are not on board their planes or conveyances. Liability of the airlines for loss, damage or delay to baggage pursuant to the provisions of the Warsaw Convention does not exceed $9.07 per pound up to a maximum of 44 lbs. for checked luggage and $400 for unchecked baggage or personal property. Where the Montreal Convention is applicable the liability of the airlines for loss, damage or delay to baggage does not exceed approximately US$1,470. AIR JAMAICA VACATIONS® has made arrangements with the airlines, hotels and other independent suppliers to provide the services and accommodations in connection with your vacation. These suppliers are independent contractors and are not employees of AIR JAMAICA VACATIONS®. AIR JAMAICA VACATIONS®, its parent, associated or affiliated companies, their agents, servants and employees, shall not be liable for any claims, actions, cause of action, injury, damage, loss, delay or expense arising out of the actions or omissions of these airlines, hotels and other independent suppliers providing services including, but not limited, to transportation, hotel, food or sightseeing services over whom AIR JAMAICA VACATIONS® has no direct control and in the absence of gross negligence on the part of AIR JAMAICA VACATIONS®. In no event shall AIR JAMAICA VACATIONS® be liable for consequential damages. AIR JAMAICA VACATIONS® accepts no responsibility for loss, damage, delay or inconvenience, whether physical or emotional, resulting from factors beyond AIR JAMAICA VACATIONS® control and in the absence of gross negligence including but not limited to Acts of God, weather, mechanical breakdowns, flight cancellations, weather, routing changes, labor disputes or strikes, disturbances, sickness, pilferage, quarantine, acts of terrorism, government actions or the failure of any aircraft, watercraft or other means of transportation to depart or arrive as scheduled, or for your failure to obtain valid documents or your failure to follow instructions. AIR JAMAICA VACATIONS® accepts no liability for loss or delay of your luggage or personal property, loss of enjoyment, loss of pay, emotional distress, upset or disappointment resulting from the actions of any airline, hotel or other independent supplier or from any factor beyond our control and in the absence of gross negligence on the part of AIR JAMAICA VACATIONS®. It is agreed by and between the passenger and AIR JAMAICA VACATIONS® that all disputes and matters whatsoever arising under or in connection with or incident to the responsibility of AIR JAMAICA VACATIONS® shall be litigated, if at all, in and before a court located in the State of Wisconsin, U.S.A., to the exclusion of the courts of any other state or country. All hotel information, terms and conditions, special offers, bonuses and/or inclusions are subject to change without notice. The right is reserved to withdraw any program and/or offer and/or make such changes as, in AIR JAMAICA VACATIONS® sole discretion, is deemed necessary at any time. All featured information, opinions and descriptions on hotels, condominiums or villas are advertisements based on such facts and representations provided by each property.
