Thank you for choosing Air Jamaica Vacations®. To ensure that you understand the terms and conditions of your particular vacation, please read the following completely. All terms and conditions are subject to change at anytime at Air Jamaica Vacations® sole discretion. VACATION TERMS AND CONDITIONS Baggage Limitations and Claims Checked baggage is currently limited to two bags per passenger in economy class and cannot exceed 50 pounds each with maximum dimensions of 62 inches. Each piece of excess baggage is subject to carrier acceptance and cannot exceed 75 pounds or 62 inches. Excess Baggage and sporting equipment is subject to an additional charge. Please contact the airline or refer to its website for current fees and policies as baggage limitations are subject to change without notice. Liability of the airline for loss, damage or delay to baggage pursuant to the provisions of the Warsaw Convention does not exceed $9.07 per pound up to a maximum of 44 lbs. for checked luggage and $400 for unchecked baggage or personal property. Where the Montreal Convention is applicable the liability of the airline for loss, damage or delay to baggage does not exceed approximately US$1,470. The airline does not accept responsibility for items such as soft luggage, fragile or perishable items. Carry on baggage is limited to one per person and cannot exceed 30 pounds with maximum dimensions of 45 inches. Booking/Payment Policies Payment may be made by agency check, certified check, cashiers check, money order or credit card (American Express, MasterCard, Visa or Discover). Payment should be express mailed to: Air Jamaica Vacations, 8969 N. Port Washington Rd., Milwaukee, WI 53217. All other non-express mail should be sent to: Air Jamaica Vacations, P.O. Box 1460, Milwaukee, WI 53201-1460. For bookings made 46 days or more prior to departure, a deposit is required. For published air reservations, 100% of air portion plus hotel deposit is due by 6PM CT the day after the reservation is made. For bulk air reservations, 100% of air portion plus hotel deposit is due within 7 calendar days of booking. For land only reservations, $150 per person deposit is due within 7 calendar days of booking. Final payment is due 45 days prior to departure. For bookings made 45-1 days prior to departure, full payment is due by 6PM CT the day of booking. For all bookings made 9-1 days prior to departure, full payment is only accepted via credit card and due at time of booking. Once air portion is paid, tickets will be issued. After ticketing, all airline penalties will apply. The Air Jamaica Vacations® Travel Protection Plan must be paid with initial deposit and cannot be added to reservation after deposit is paid. Separate payment policies may apply to holiday travel, peak periods and promotional sales. RESPONSIBILITY Travel Agent Responsibility Your travel agent is responsible for providing information to you, examining and verifying all information, and ensuring that you understand all of the policies, fees and requirements to which you are subject. Any travel agent who makes a reservation on your behalf acknowledges this responsibility. Your Responsibility You must check in at least 2 1/2 hours prior to the scheduled departure and report to the gate at least 30 minutes before departure time. Failure to comply with these conditions may result in the loss of your seat. You must examine all information to ensure accuracy and call to verify flight times prior to departure. Your rights and remedies set forth herein are in addition to any other rights and remedies under applicable law, but if you agree to a refund, you waive all other remedies. Unless you file any claim you may have with Air Jamaica Vacations® within 30 days after the termination of trip, all parties are released from further liability. Airline Responsibility Air Jamaica is responsible only for the air transportation it provides in connection with a vacation and is not responsible for ground transportation, accommodations, or other features of a vacation. Air Jamaica shall not be liable for any loss, injury, accident, delay or irregularity which may occur by reason of defect or through the acts or omissions of any person or company performing or rendering the services described in vacation brochures and/or flyers. The services described in vacation brochures/flyers other than air carriage are furnished by independent contractors who are not servants, joint venturers or partners with Air Jamaica. All flights are subject to the Air Jamaica Contract of Carriage which may be seen on request by contacting an Air Jamaica ticket office. Air Jamaica Vacations® Responsibility Air Jamaica Vacations® is acting as a tour operator and is responsible for arranging the services provided in the travel packages outlined in this brochure. All other suppliers providing transportation, optional tours and lodging accommodations for Air Jamaica Vacations®, including Air Jamaica, are independent contractors and are not employees of Air Jamaica Vacations®. All travel documents are issued subject to the terms and conditions specified by the suppliers. Air Jamaica Vacations®, its parent, associated or affiliated companies, their agents, servants and employees shall not be liable for any loss of or damage to property or injury to person caused by reason of any defect, negligence or other wrongful act or omission, of any other transportation company, lodging property, agency or any persons, including Air Jamaica Vacations®, rendering any of the services included in the vacation package. In no event shall any party be liable for consequential damages. In the event the Air Jamaica Vacations® services or accommodations cannot be provided due to delays or any other reason beyond the control of Air Jamaica Vacations®, Air Jamaica Vacations® will exercise all reasonable efforts to arrange alternative comparable services or accommodations. However, Air Jamaica Vacations® will not be liable for, and customer hereby waives any claim against Air Jamaica Vacations®, for any failure of performance by any other transportation company, lodging property, agency or any other third party providing services hereunder. It is agreed by and between the passenger and Air Jamaica Vacations® that all disputes and matters whatsoever arising under or in connection with or incident to the responsibility of Air Jamaica Vacations® shall be litigated, if at all, in and before a court located in the State of Wisconsin, U.S.A., to the exclusion of the courts of any other state or country. Air Jamaica Vacations® does not assume responsibility for errors or omissions in the content of the advertisements or other information herein. Photographs and maps shown are for informational purposes only. All featured information, opinions and descriptions on hotels, condominiums or villas are advertisements based on such facts and representations provided by each property. All hotel information, terms and conditions, special offers, bonuses and/ or inclusions are subject to change without notice. The right is reserved to withdraw any program and/or offer and/or make such changes as, in Air Jamaica Vacations® sole discretion, is deemed necessary at any time. Documentation Air Jamaica Vacations® reservations are ticketless except for reservations including infants under the age of two. An email confirmation will be sent to the email address provided at time of reservation. Air Jamaica Vacations® is not responsible for non-deliverable emails. Always check your travel documents for accuracy upon receipt. Revisions Once payment has been received, a revision fee of $15 will be due per booking each time changes are made to a reservation. If a revision requires re-issuance of an airline ticket, a re-ticketing fee of $100 will be due in addition to the revision fee. Certain airfares do not allow any changes. Hotel Taxes and Service Fees Air Jamaica Vacations® markets hotels under a “prepaid/merchant” model, where the full amount is collected from you in advance and payments are sent to the hotel on your behalf. In connection with facilitating your hotel arrangement, the amount you are charged will include taxes and service fees. This amount includes an estimate to recover the amount Air Jamaica Vacations® pays to the hotel related to your reservation for taxes owed by the hotel including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value added tax, good and services tax, and/ or other similar taxes. The amount paid to the hotel in connection with your reservation for taxes may vary from the amount Air Jamaica Vacations® estimates and includes in the amount charged to you. The amount charged to you also includes an amount to compensate Air Jamaica Vacations® services as well as covering costs incurred in connection with handling your reservation. Air Jamaica Vacations® is not the vendor collecting and remitting taxes to the applicable taxing authorities. The hotel suppliers, as vendors, include all applicable taxes in the amount billed and Air Jamaica Vacations® pays over such amounts directly to the vendors. Air Jamaica Vacations® is not a co-vendor associated with the vendor with whom we book or reserve our customer’s travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location. Important Notice The Mark Travel Corporation, its employees, officers, directors and shareholders (collectively “Air Jamaica Vacations”) does not own, control or operate any hotel or any air, land or water transportation vehicles or companies of any kind, including without limitation, airplanes, helicopters, boats, rental cars, ground transportation vehicles, transport companies, shuttle services, buses, or local tour companies which may offer excursions or tours.
