King's Hawaiian files legal
complaint against Alpha Baking
GAINESVILLE, GA. - Eight days after
reaching a settlement with grocer Aldi
regarding a dispute about packaging,
Torrance, Calif.-based King's Hawaiian
Holding Co., Inc. filed another lawsuit,
this time against Chicago-based baker
Alpha Baking Co.
The complaint was filed Jan. 19 in the
U.S. District Court Northern District of
Georgia Gainesville Division. At issue is
Alpha Baking's selling of sweet rolls in
product packaging that King's Hawaiian claims is "deceptively similar to the
King's Hawaiian Sweet Roll packaging
trade dress."
"(Alpha Baking's) conduct is likely
to cause consumers to be confused, deceived or mistaken into believing that
there is an affiliation, connection or association between defendants and King's

Hawaiian, or that defendants' products
originate from or are sponsored by or approved by King's Hawaiian," according to the complaint.
The lawsuit claims the sweet
rolls have been sold at various
stores across the United States,
including Brookshire, Super 1
Foods, Bashas' and Albertsons
grocery stores, and at Costco Wholesale warehouses.
King's Hawaiian also claims
Alpha Baking manufactured
the sweet rolls sold at Aldi's,
and that the company developed and paid
for the design of the packaging.
"(Alpha Baking has) placed the infringing sweet roll products into the stream of
commerce, with knowledge or understanding that such products would be

Wegmans to showcase specialty
mill inside of supermarket
ROCHESTER, N.Y. - Wegmans Food Markets, Inc. has installed a handcrafted mill
near the bakery inside its store in Pittsford,
N.Y. Wegmans said it is likely the first mill
inside a supermarket in the United States.
Nick Greco, Wegmans' bread artisan,
helped the supermarket chain find the
mill, which was built by a family-owned
company based in Austria. The mill is 10

by 4 by 7 feet, and made with Alpine pine
with a stone grinder inside.
For now, the mill will be used to make
flour only for Einkorn Rye bread, Wegmans said, but once the supermarket
chain's bakers are familiar with producing that loaf the mill will be used to make
other stone-ground, local, organic flours
for other varieties of bread.

Sabert Corp., Kalman sign
bakery packaging deal
SAYREVILLE, N.J. - Sabert Corp., a global
food service packaging manufacturer, has
entered into a definitive agreement to acquire Kalman Packaging Inc., a Graham,
N.C.-based manufacturer of thermoformed
plastic hinged food containers, focused on
the bakery/supermarket sector. Financial
terms of the transaction were not disclosed.
Sabert said the acquisition of Kalman

broadens its reach across multiple channels and reflects its desire to get into the
bakery segment, which the company has
identified as a growing category.
"We are delighted to announce this acquisition, which is consistent with our company's mission to enhance and advance the
way people enjoy food," said John Healey,
president of Sabert North America.

Ingredion expanding in Asia-Pacific
WESTCHESTER, ILL. - Ingredion Inc.
has entered into a definitive agreement
with Pingyuan County Juyuan StateOwned Asset Management Co., Ltd.
to acquire the state-owned Shandong
Huanong Specialty Corn Development
Co., Ltd. in Pingyuan County, Shandong
Province, China. Financial terms of the

transaction were not disclosed.
Ingredion said the acquisition supports its specialty ingredients business
in China and has been approved by the
company's board of directors. The transaction remains subject to approval by
Chinese government authorities as well
as to other customary closing conditions.

clear window on the front of
the package, with the color orange as the primary element
around the clear window;
within the area of the window, writing against a contrasting background; and,
on the front of the packaging, no word appears in larger font than the word "Hawaiian."
King's Hawaiian seeks the cessation of
the similar packaging and damages.
A spokesperson for Alpha Baking said
the company does not comment on any
ongoing legal discussions. MBN
A loaf of Einkorn Rye will retail for
about $5.50.
"Baking with flour made from locallysourced grains, right out of the mill, is a
very special experience," Mr. Greco said.
"There are flavor notes, and a subtle
sweetness you can taste in a really fresh
loaf that aren't there if a few weeks have
passed since the flour was milled."
Wegmans Food Markets, Inc. is an
88-store supermarket chain with stores
in Maryland, Massachusetts, New Jersey,

the new relationship will help Sabert and
