that ensures the product going into the
bottle is what the label claims it to be.
This settlement further demonstrates
that warnings and disclosures might
not adequately protect consumers.
In response, ILMA leadership
is initiating a campaign to educate
consumers and retailers to create
more stringent consumer labeling
requirements and, most importantly,
get obsolete oils off retailers' shelves.
California is First Out of the Gate
California was the first state to address
obsolete oils with the passage of A.B.
808, which became effective Jan. 1,
2016. The law prohibits the sale or dis-
tribution of engine oils for use in an internal combustion engine in California
unless the product conforms to at least
one active API classification, one active
sequence of the European Automobile
Manufacturers' Association (ACEA)
"European Oil Sequences specification"
or an active original equipment manufacturer (OEM) specification.
Holly Alfano, CEO of ILMA, said
that while ILMA supports the intent
of the California law, the Association
has been working with the state's Department of Food and Agriculture as it
develops regulations implementing the
statute to make changes that take into
account specialty, or purpose-built,
oils, including motor oils, used in
applications that do not meet current
specifications. Oils for antique cars,
high-performance racing cars, and
lawn and garden equipment are examples of the necessary exceptions. Those
regulations have not been formally
proposed yet, but Alfano is hopeful
that ILMA's pre-proposal comments
will be taken into consideration.
