product packaging requirements and
a wide range of consumer products.
NIST publishes the standards as
adopted by the NCWM in NIST
Handbook 130. A number of states
will automatically adopt the standards into law, or send them to the
state legislature to pass into law. In
other states, Handbook 130 becomes
a regulatory framework, providing a
template from which state agencies
develop consumer regulations.
Ronald Hayes, division director of
the Missouri Department of Agriculture Weights, Measures & Consumer Protection Division and the
NCWM vice chairman of the Fuels
and Lubricants Subcommittee, said,
"The purpose of these Uniform Laws
and Regulations is to achieve, to the
maximum extent possible, uniformity
in weights and measures laws and regulations among the various states and
local jurisdictions in order to facilitate
trade between the states, permit fair
competition among businesses and
provide uniform and sufficient protection to all consumers in commercial
weights and measures practices."
In October 2016, ILMA submitted
a proposal to update the language in
Handbook 130 as it relates to the sale
of obsolete oils. The proposal submitted is similar to the California's law but
gives exceptions to purpose-built oils.
ILMA is proposing that the state
regulations make distinctions for:
* Vehicle motor oil (motor oil for
light- to heavy-duty vehicles including cars, sport utility vehicles
(SUVs), vans and trucks)
* Recreational motor oil (motor oil
used in four-stroke cycle engines
used in motorcycles, including
minibikes and dirt bikes, all-terrain vehicles (ATVs), golf carts
and other self-propelled vehicles
that are not passenger cars)
* Non-transportation motor oil
(motor oil used in generators and
lawn and garden equipment)
* Racing oil (for race cars, dragsters, hot rods, funny cars and
other vehicles modified for racing
and/or spectator performance)
Within its proposal, ILMA is also
suggesting that a warning accompany
nonvehicle motor oils clearly indicating
on the front of the container that the
product is not recommended for use in
gasoline-fueled passenger car engines:
