oppose a particular activity. There is
plenty of room here for continued
deregulation success.
Compliance costs are highly visible
and receive a lot of criticism. However,
academics try to distinguish between
"costs of regulation" and "compliance
costs," with the former including
indirect costs, such as staff time to
read and digest a rule in the Federal
Register. I instead try to look at rules
coming out of Washington, D.C., for
the creation of barriers to entry for
ILMA members. The deregulation
concept that flows here is whether new
rules safeguard and promote compet-
itive markets rather than restrict them
or eliminate competitors. My concern
is that, while the Trump administration "gets it," will the administration
be able to sustain its focus on increasing competition?
The Trump administration's deregulation efforts have touched a bit on
each of the above concepts, although
the president largely has spent his first
year in office undoing or stopping
Obama-era rules. Going forward,
there is more room for the White
House and the agencies to exercise
their discretion in pushing one form
of deregulation over another, in part
as a response to political pressures and
incentives. In thinking about how
such judgment will be exercised, it's a
safe bet to assume that curtailing those
rules that matter to key supporters in
Trump's base will continue to receive
priority attention. Beyond that, what
deregulation will look like in practice
over the next three years remains an
open question.
