Inventory 'Reset' Importer Dilemmas

The Feb. 7 Toxic Substances Control Act (TSCA) inventory
reporting deadline has come and gone. But for many
importers, the work continues, and potential enforcement concerns grow. What many imagined to be a
relatively simple and straightforward process became
complicated and slow, leaving some importers uncertain about how to accomplish their ultimate compliance.
For those unfortunate importers, uncertainties and
consequences loom.
MISIMPRESSIONS
Let's begin by acknowledging that many import-based supply
chains smoothly responded to the requests for essential information, enabling those importers to complete the task on
time. This was not mere happenstance. Of course, importers
with very few reportable substances, and those with unusually strong leverage over non-U.S. suppliers, had a distinct
advantage. But most who finished the process by the deadline
started very early and managed the process diligently.

Many others, however, fared quite differently. They experienced difficulties producing reliable and sufficiently detailed
import records. Some misjudged their ability to rely on the
Central Data Exchange (CDX) receipts of other notifiers.
Perhaps the most prevalent obstacle was the effort required
and the difficulty in obtaining needed information from their
non-U.S. suppliers, regardless of the reason for its absence.
When the TSCA Inventory "Active-Inactive" Notification
Rule was published and explained in its final form by the U.S.
Environmental Protection Agency (EPA), emphasis was placed
on the minimization of details required and the simplicity of
the notification process. This emphasis, reinforced by commentary from other sources, seemed to have a disarming effect on
many people in the reporting community. This effect, combined with the competing demands of other business priorities,
caused a significant percentage of the notifying community to
delay its efforts and minimize resources assigned to the task.
Had the process proved to be as straightforward as it had been
perceived, the delay might have been understandable.
A second point of confusion concerns the references
made by the EPA to the use of CDX receipts provided by
other notifiers as a substitute compliance option. Although
the EPA did not explain its motivation, the provision was
