while at the same time promoting
economic growth [and] minimizing
regulatory uncertainty."7
The agencies, in response to the EO,
have begun a two-step rulemaking
process to reconsider the WOTUS
rule. The first step was a proposal to
rescind the Obama-era definition of
"Waters of the United States" and
recodify the previous definition. In the
second step, the agencies are working
to reconsider and revise the scope of
the regulation overall. According to
the EPA's Unified Agenda, the agency
is expected to finalize the Obama-era
WOTUS definition repeal in April
2018, and propose a replacement
regulation in May 2018.
As this article goes to print, a
proposed rule outlining the new
parameters of "WOTUS" has not
been published; however, it is expected
that the forthcoming regulation will
be much more limited in scope. A
more limited rule would be consistent
with EPA Administrator Scott Pruitt's
mission to bring the agency "back to
basics," refocusing on its core mission, returning power to the states to
administer environmental laws and
adhering strictly to the rule of law.
5. Under the settlement terms of a "sue-tosettle" lawsuit, the EPA agreed to promulgate
a final rule expanding the SPCC program to
include tanks storing "hazardous substances" in
2019. A majority of the manufacturing community, including ILMA members, will be affected
by this rulemaking.

to delegate authority to the EPA to regulate any
activity that occurs in or on that body of water.
