companies as shown above.
While appreciative that the EPA
considered small entities in the proposed rule, ILMA had advocated for
an alternative fee schedule for small

businesses that more appropriately
reduces the financial burden.3
Overall, the new authority the EPA
possesses to functionally "tax" the chemical industry to offset the agency's costs
and reduce the need for congressional
appropriations will very likely increase
the costs for a variety of products.

EPA considered small
entities in the proposed rule, ILMA had
advocated for an alternative fee schedule
for small businesses."
The agency, hopefully, will lower
some of its fees in the final rule and
more appropriately account for small
businesses; however, the new TSCA
reality remains. The EPA has expanded
statutory authority to collect higher
user fees from industry, and those fees
will likely result in increased operating
costs moving forward.
1 ILMA also highlighted the concern that if fees
are too high for activities such as a PMN review,
the fees could have the unintended consequence of stifling technological innovations
if companies are dissuaded from developing
new products because of the cost.
