Residential Through-the-Fence
and Your Business

n-airport service
businesses such as
FBOs, repair stations
and flight schools
are usually subject to
significant regulation by their airport
sponsor, often including requirements
for service levels, minimum
facility requirements and insurance.
In addition to the rules an on-airport
service business must follow, these
businesses are usually required to pay
some combination of fees, rents or
other charges to the airport sponsor.
All similarly situated businesses are
held to the same standards, keeping
the field of competition level. One of
the long-held concerns of on-airport
service providers is through-the-fence
competition. Through-the-Fence
(TTF) refers to the ability of an offairport
service provider to come onto
the airport to provide services. Such
off-airport businesses, often, are not
held to the same standards, rents and
fees as on-airport providers since
their operation is not located on airport
sponsor-owned property.
Over the last three years, a new
version of the TTF issue began to
receive national attention, RTTF or
Residential Through-the-Fence. RTTF
is similar to TTF in that it involves
access to the airport directly from
adjacent non-airport owned properties,
except in the case of RTTF where
the access is for a homeowner and his
aircraft. In 2009, the Federal Aviation
Administration (FAA) began reviewing
RTTF access at publicly supported
airports. The FAA’s conclusion was
that, while federal grant assurances
prohibited airport sponsors from
entering into RTTF agreements, the
agency had “approved” some agreements
in the past. The FAA revised
its policy to make clear that RTTF
agreements were incompatible with
