said they want control over their schedules,
with one in four expressing a
desire to select their specific shifts.

life commitments, healthcare
providers increasingly seek flexibility in
their work.
It is important to distinguish the differences
between W-2 on-demand labor
and 1099 nursing job apps. Apps with
1099 workers may seem like a convenient
solution for healthcare institutions
seeking on-demand staffing. The
concept is relatively straightforward:
healthcare facilities post shifts, and
local nurses quickly fill them. However,
there is more to unpack here.
These gig apps typically engage
1099 independent contractors instead
of hiring W-2 employees. This approach
places healthcare organizations in a
" co-employer " position, exposing them
to financial risks such as workers' compensation
disputes, malpractice claims,
and unpaid overtime challenges. Additionally,
the autonomy granted to independent
contractors can lead to a
temptation to bypass organizational
policies with minimal repercussions.
The rise in reports of worker misclassification
within the healthcare sector
has garnered increased attention postpandemic,
prompting heightened regulatory
scrutiny from agencies like the US
Department of Labor.
Given these complications and potential
liabilities, healthcare organizations
that are considering the 1099
labor route should proceed cautiously.
