Non-Discrimination Businesses are required to comply with various non-discrimination laws, including laws forbidding discrimination on the basis of ethnicity, national origin, color, race, religion and sex. They also are required to provide reasonable accommodations to employees with disabilities. It is normal for an employee handbook to include a boilerplate statement of the company’s non-discrimination policy. But, this policy can be enhanced if the manual can provide specific guidance on unacceptable conduct.

Note that non-discrimination policies must be enforced in order to provide the business with legal protection from claims of discrimination. Do not write a policy you are not willing to enforce against your favorite employee. Performance Expectations It is common to describe the company’s expectations in the employee handbook. This can include expectations concerning conduct, such as the sort of conduct deemed acceptable or unacceptable, work schedule, operating hours and when employees are expected to work and compliance (the expectation that employees will remain in full compliance with all applicable state and federal regulations).

Conclusion There are many resources available online to aid in the development of an employee handbook. Some U.S. government agencies publish employee handbook templates to make it easy to cut-and-paste your own handbook. When using these templates, please make sure to read them carefully and all of the text accurately reflects your business’s practices and protocols. While it is tempting to rely solely on these online templates, you should not hesitate to consult an attorney about this process. Employment law is rife with litigation, and it is better to create a manual that will protect you than to create one which exposes you to unforeseen liabilities. q
