So, here we have the regulation that states “if an article is required to be approved...” Where does the rule require articles to be approved? For examples of where “this chapter” requires articles to be approved, I like § 91.205 (b) (11): For small civil airplanes certificated after March 11, 1996, in accordance with Part 23 of this chapter, an approved aviation red or aviation white anti-collision light system. Or, § 91.205 (b) (13): An approved safety belt with an approved metal-to-metal latching device for each occupant 2 years of age or older. Or, for avionics § 91.223 terrain awareness and warning system: ... no person may operate a turbine-powered U.S.-registered airplane configured with six or more passenger seats, excluding any pilot seat, unless that airplane is equipped with an approved terrain awareness and warning system... FAA order 8900.1, volume 4, chapter 14, section 2 reinforces this conclusion by stating that “Title 14 of the

Code of Federal Regulations requires certain avionics instruments and equipment be approved regardless of whether the aircraft is operated as an air carrier or under general aviation.” So, if the regulation is moot on the requirement that an article be approved, then there is no explicit requirement. But, this doesn’t mean it’s a free-for-all either. Parts still must conform to the type design as a replacement part or the type-certification basis as a modification part. And, of equal importance, a record of the inspections and tests should be included in the maintenance record documenting the installation.

Transport Canada Issues Additional Guidance for CAR 521
Transport Canada Civil Aviation has issued four additional advisory circulars to provide guidance on the requirements published in CAR 521, Approval of the Type Design or a Change to the Type Design of an Aeronautical Product. AEA Canada members may be particularly interested in the following:

AC 521-005, Supplemental Type Certificates
This AC provides guidance on the procedures necessary to meet CAR 521 requirements for an STC application and issuance, including guidance on the use of test or computation (analysis) methods that may be used to demonstrate compliance. With respect to subsequent changes to the design approved by an STC, TCCA states it is not intended that the STC be revised for changes in design or documentation that would be considered “minor.” Changes to the STC that would require an amendment to the certificate may include:

Updating of supporting technical data (top drawing list, approved sections of the flight or maintenance manual supplement). ◦ Note: The phrase “or later approved revisions” may be used in conjunction with the documentation referenced on certificates to alleviate the requirement to issue an amended certificate because of revisions associated with supporting documentation. • Changes in airworthiness limitations originally prescribed. • Additions, deletions or changes of aeronautical product models or types. • Cross–reference to other approval certificates having a direct impact on a given approval. • Change of address or transfer of ownership.
