had the same or similar control or interest in a
certificate holder whose repair station certificate
was revoked, or is in the process of being revoked,
and that individual materially contributed to the
circumstances causing the revocation or causing
the revocation process.
During the NPRM process, the AEA and other industry trade associations raised serious concerns regarding
the rights and possible discrimination of individuals
who could be arbitrarily identified as a key person
in a failed repair station. In response, the FAA added
paragraph (f), which requires that "If the FAA revokes
a repair station certificate, an individual described
in paragraphs (e)(2) and (3) of this section is subject
to an order under the procedures set forth in 14 CFR
13.20, finding that the individual materially contributed to the circumstances causing the revocation or
causing the revocation process."
Part 13 addresses investigative and enforcement
procedures, while section 13.20 specifically addresses
orders of compliance, cease and desist orders, orders of
denial, and other orders.
Currently, section 145.55 allows that a repair station certificate or rating issued to a repair station is
effective from the date of issue until the repair station
surrenders it or the FAA suspends or revokes it (for
repair stations outside of the U.S., it is effective for 12
months with the FAA option of 24 months.) The FAA
included a revision to add that a "certificate surrender"
is not complete until the FAA accepts the certificate for
cancellation. Also for repair stations outside the U.S.
(who are required to pay a fee for services), there is a
revision to add a new paragraph (c)(3) to require that a
repair station outside the U.S. applying for certificate
renewal must show the required fee has been paid.
The agency revised the amendment to or transfer of
certificate (section 145.57) by allowing the new owner
who acquires the assets of an existing repair station
certificate to choose between applying for an amended
or new certificate. Previously, the rule only allowed for
the new owner to apply for an amended certificate.
The regulations currently require supervisory personnel, inspection personnel and personnel authorized
to approve an article for return to service to be "certificated under Part 65." The omission of the term
''appropriately'' in the 2001 final repair station rule

was a recognized oversight on the part of the FAA.
Technically, the rule allows any individual holding a
certificate issued under Part 65 (including air traffic
control tower operators, aircraft dispatchers and parachute riggers) to qualify for these positions.
The FAA has revised supervisory personnel requirements (§ 145.153(b)(1)); personnel authorized to
approve an article for return to service (§ 145.157(a));
and inspection of maintenance, preventive maintenance or alterations (§ 145.213(d)) by adding the
terms "appropriately" before "certificated" and "as a
mechanic or repairman'' before ''under Part 65'' in all
three instances.
Under these amendments, individuals who are
required to be certificated would, at a minimum, have
to hold a certificate appropriate for the work being
performed (a mechanic or a repairman certificate, for
example). The key point is that their certificate should
cover the work being performed. An area of possible
concern is that a mechanic is not appropriately rated
to perform instrument repair or alterations, (section
65.81), and as such, they would likely need a repairman's certificate if they are to supervise, perform final
inspection or RTS instrument repairs or alterations.
The final area of attention for changes in the repair
station regulations is section 145.221 on service difficulty reports. The FAA has deleted the adjective "serious" in its requirement for reporting failures, malfunctions and defects. The FAA makes incorrect assumptions
in its final rule. It is interesting that FAA rulemaking did
not catch this egregious error during the review process.
Repair stations fix things - they repair "failures, malfunctions and defects." Without the adjective, all work
that isn't an inspection or alteration would qualify to be
reported under the revised SDR language.
The AEA, in partnership with other industry trade
associations, petitioned for immediate relief from this
ill-thought proposal. But in the event the relief does
not come before Nov. 10, every maintenance action
accomplished by a repair station other than installations and inspections must be reported to the FAA via
the service difficulty report. Yes, the industry is quite
aware of what this reads. And yes, it will crash the
FAA's computer system if all 4,000-plus repair stations
submit every work order as an SDR. When this occurs,
perhaps the FAA will understand how completely
ridiculous its requirement actually is. It certainly gives
a whole new meaning to the phrase, "Be careful what
you ask for!" q
