Upcoming Regulatory Activities at
Transport Canada
With the introduction of the new Canadian Aviation
Regulation Advisory Council process, Transport Canada
Civil Aviation will be moving ahead with several regulatory
amendments and advisory circular publications. The most
significant of these is the changes to CAR 521. After the
issuance of the preliminary issue and consultation assessment
for this regulation, the TCCA received only a few comments
and was preparing to issue the NPA (notice of proposed
amendment) for the second week of April. This will be followed by an online consultation and then a meeting scheduled for late June. With the introduction of CAR 521, several
issues have been noted through its implementation, and many
complaints were received. This is an opportunity for the users
and public to have input on the proposed changes and to
ensure these issues are resolved.
Drafting of changes to chapter 537 of the Airworthiness
Manual also are underway in order to reorganize its structure
so it will be easier to follow. These changes will harmonize a
little closer to Federal Aviation Regulation 37 and also allow
for the acceptance of Canadian companies to use ETSO
(European technical standard order) requirements instead of
the Federal Aviation Administration TSO requirements.
NPAs also are being drafted to harmonize with the FAA
rules for ETOPS and icing activation.

updated or issued for the first time:
* SI and AC 521-002, Rev 2, Type Certification
Requirements of Aircraft, Engines and Propellers.
* SI and AC 521-004 Rev 2, Changes to the Type
Design of an Aeronautical Product.
* AC 500-013, Rev 2, Carriage of Bulk Liquids.
* AC 500-015, Rev 2, Certification Plans.
* SI 500-018, Rev 2, Document Transfers.
* AC material for ADs and CAN-TSO Procedures.

QUESTION:

If I hold an AMO or approved manufacturing certificate in Canada, is there a need to hold
a distribution certificate in order to sell to a third
party new parts not manufactured by the AMO or
approved manufacturer?

ANSWER:

No, these certificate holders do not require a
separate distribution certificate.
Airworthiness Manual 563 states explicitly
that it does not apply to approved manufacturers.
Appropriate procedures need to be developed to
cover distribution of parts not manufactured by
them. For AMOs, MPL No. 8, covering distribution of aeronautical products, identifies that a
distributor certificate is not required, as long as the
parts distributed are received with proper airworthiness tags (or C of Cs for standard parts) and are
part of the AMOs normal business.
The AMO must develop procedures to cover
this and identify how the parts will be tagged. Use
of the Form One would be appropriate, as long
as it meets the requirements of AWM 563 or a
statement is added that indicates the certification
relates to the inspection of a new item. The original
release certificate from the manufacturer can be
forwarded, also. Check with your local PMI to
ensure you have incorporated proper procedures
into your manual.
