available to the FAA.
"If law enforcement officers
show up with the FAA intending to
use the FAA's ability to enter for
compliance purposes as a pretext
to really inspect for some other
reason, then you should approach
the situation with caution,"
Dickstein advised.
Whether by contractual
agreement or not, the FAA may
revoke the aircraft's certificate of
airworthiness as a way to make the
owner comply with an inspection.
FIND A GOOD AVIATION
ATTORNEY
Very few attorneys understand
the complexity and ramifications
of FAA regulations. Seek
knowledgeable counsel before you
need it. Look for a lawyer who has
both experience and expertise in the
aviation industry, Dickstein advised.
"If you talk to a standard
criminal lawyer, they'll probably
tell you don't let the FAA in,
that they don't have the right
to enter without a warrant, not
realizing there is a regulatory
hook that allows the FAA to
enter," Dickstein said. "While,
constitutionally, you can keep
them out, the payback on that
is your certificate will likely be
suspended until you let them enter,
and possibly revoked. You want to
support your legal rights, but there
are real business implications in
how you do that." q
