European Aviation Safety Agency
The European Aviation Safety Agency indicated
that it is hoping to come to a final decision on the
mutual acceptance of ETSO/TSO authorization with
the FAA.
This would allow organizations on both sides
of the Atlantic to use the (E)TSOs without further
validation of the other agency. Some additional
obligations may need to be taken by the installing
design organization, however. The agreement,
once agreed, will be identified in the technical
implementation procedure to the Bilateral Aviation
Safety Agreement. The agreement may be
announced in September. A similar arrangement
for supplemental type certificates is planned for
discussion at the same time.

Maintenance release of aircraft not
covered by the Basic Regulations
The following information is from the European Aviation Safety Agency.

QUESTION:
Can a Part 145 organization provide a maintenance release for
an aircraft (or component) not covered by the Basic Regulations?

ANSWER:
It is the position of the European Aviation Safety Agency that
a maintenance release for aircraft that are not covered by the
Basic Regulations is a violation of EASA Part 145. Such release
is issued outside of the privileges granted to the Part 145.
Why an EASA Part 145 organization cannot issue an EASA
Part 145 (145.A.50) release for aircraft not covered by the
Basic Regulations:
Those aircraft identified are excluded from complying
with the airworthiness requirements contained in the Basic
Regulation (EC (No.) 2042/2003 and EU (No.) 748/2012.
As a consequence, they are subject to the airworthiness

In addition, the transition from operational
evaluation board reports to operational suitability
data has been explained by the EASA in a letter
issued in March.
Prior to the entry into force of EU 69/2014, JAA
and then EASA prepared OEB reports based on
requests from the industry and when significant
STCs were developed. The letter identifies that
OEB reports and MMEL issued in agreement
with the JAA procedure or by the agency prior to
the entry into force of EU 69/2014 are deemed
to constitute the OSD in agreement with the new
regulation. Type certificate holders shall have
proposed to the agency a division of such OSD into
mandatory and nonmandatory data until June 18,
2014.
The transition of OEB reports will be completed
with the inclusion of OSD references in the
relevant TCDS. The OEB reports concerned will be
withdrawn from the EASA website, and associated
OSD documents will be held by the manufacturer
(TC/STC holder).

requirements established in the national regulations of the
corresponding state.
Since the competent authority responsible for the EASA
Part 145 approval does not have any legal power, under the
EU system, to approve maintenance procedures for aircraft
not covered by the Basic Regulation, nor to perform the oversight of such maintenance activities, it follows that the maintenance organization exposition of the approved EASA Part
145 organization can only contain a scope of work and procedures relative to aircraft covered by the Basic Regulations.
Issuing an EASA Part 145 (145.A.50) release is the last
step of a chain of airworthiness requirements under the EU
legal system, and it is a privilege contained in 145.A.75. This
privilege is limited to maintenance performed on aircraft for
which the organization is approved and always in accordance
with the approved maintenance organization expositions.
It follows form here that the EASA Part 145 (145.A.50)
release can only be performed on aircraft covered by the
Basic Regulation. Any other aircraft can only be released
under the national regulations and procedures of the corresponding state, which means that such maintenance releases
are issued completely in the national domain. They are not
EU/EASA releases and are not issued in accordance with
EU law. The EASA, therefore, has no legal competence or
responsibility over them. q
